Terms of service

Effective April 26, 2026

These Terms of Service (“Terms”) govern your access to and use of the websites at zoriac.dev and app.zoriac.devand the cron-monitoring service offered through them (collectively, “Zoriac” or the “Service”), operated by Eric Catalano (“we”, “us”, “our”). By creating an account or using the Service you agree to be bound by these Terms.

1. The Service

Zoriac receives HTTP “heartbeat” pings from your scheduled jobs and notifies you when an expected ping does not arrive within the schedule + grace period you configure. We do not execute your code; we simply listen for pings, store metadata about them, and send alerts.

2. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 13 years old (16 in the European Economic Area) to create an account. The information you provide must be accurate and kept up to date.

3. Acceptable use

You agree not to use the Service to:

  • Send pings on behalf of jobs you are not authorized to monitor.
  • Use ping payloads to transport unrelated data, exceed posted size limits, or use the ping endpoint as a generic relay.
  • Harass, defame, or send unsolicited messages to other users or recipients of our alert emails.
  • Attempt to break, probe, or disrupt the Service, including by flooding ping endpoints, attempting to bypass rate limits, or attempting to gain access to checks you do not own.
  • Violate applicable law (including export control, sanctions, and privacy law).

We may suspend or terminate accounts that violate this section without prior notice when we believe the violation is material or ongoing.

4. Plans, billing, and refunds

Paid plans are billed in advance for the period you select (monthly or yearly) by Stripe, our payment processor. Subscription fees are non-refundable except where required by law. You may cancel at any time; cancellation takes effect at the end of your current billing period and you retain access until then. We may change pricing on future renewal periods with at least 30 days’ notice.

5. Service availability

We work hard to keep Zoriac running, but the Service is provided on an “as is” and “as available” basis. We do not offer a contractual uptime guarantee or service-level agreement during early access. If a customer-impacting outage occurs we will publish status updates and post-mortems and, in our discretion, may credit affected accounts.

6. Your data

You retain all rights to the data you submit to Zoriac (check configurations, ping bodies, etc.). You grant us a limited license to store, process, and transmit that data for the purpose of operating the Service and providing it to you. We do not sell your data and we do not use ping payloads to train machine learning models.

7. Intellectual property

The Zoriac name, logo, design, source code (except where open-source licensed), and documentation are owned by us. The open-source components of Zoriac (CLI, integration snippets) are licensed under their respective licenses (MIT unless stated otherwise) and your use of those components is governed by those licenses.

8. Termination

You may delete your account at any time from the Settings page. Upon deletion we will, within 30 days, remove your checks, ping history, and personal information from our active systems, except where retention is required by law (for example, billing records). We may terminate or suspend your account if you breach these Terms, fail to pay for the Service, or if continued provision would expose us to legal risk.

9. Disclaimer of warranties

ZORIAC IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, that notifications will always arrive, or that the Service will detect every job failure.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL ZORIAC OR ITS OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, OR DATA, ARISING OUT OF OR RELATED TO THE SERVICE. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES UNDER THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS, WHICHEVER IS GREATER.

11. Indemnification

You agree to defend and indemnify Zoriac against any third-party claims arising from your use of the Service in violation of these Terms or applicable law.

12. Changes to these Terms

We may update these Terms from time to time. If a change is material we will notify registered users by email at least 14 days before the change takes effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Alameda County, California.
